By downloading, installing, or using any Vitalis app — Vitalis Core, Vitalis Motion, Vitalis Somna, or Vitalis Nourish (collectively, "the apps") — you agree to be bound by these Terms of Service. If you do not agree, please do not use the apps.
These Terms apply to all users, including beta testers, free users, and (in the future) paid users.
You must be at least 17 years old to use Vitalis. If you are between 13 and 17, you may use Vitalis only with the consent and supervision of a parent or legal guardian. Vitalis is not intended for users under 13.
Subject to your compliance with these Terms, Vitalis grants you a limited, non-exclusive, non-transferable, revocable license to install and use the apps on iOS devices that you own or control, for your personal, non-commercial use.

Vitalis is a consumer wellness tool. It is not a medical device and does not provide medical advice. Please read our full Medical Disclaimer — it is incorporated into these Terms by reference.
Health data created and stored within Vitalis remains on your device. We do not collect or store your health data on our servers. See our Privacy Policy for full details.
You retain all rights to the data you create. By using the apps, you grant Vitalis a limited license to process that data locally on your device for the purpose of providing app functionality (e.g., calculating averages, generating charts, displaying summaries). This license does not extend to any server-side processing because we do not perform server-side processing on your health data.
If you participate in a Vitalis beta program (TestFlight, public beta, or otherwise), you acknowledge that:
Vitalis is currently free during private and public beta. When paid tiers launch, they will be governed by Apple's App Store payment terms. We commit to:
The Vitalis name, logos, app designs, source code, and all related materials are the intellectual property of Vitalis and are protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right to use Vitalis trademarks except as expressly permitted.
The apps may incorporate open-source software components. Where applicable, those components are governed by their respective licenses, which take precedence over these Terms with respect to those components. A list of open-source components is available within the apps or upon request.
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. YOUR USE OF THE APPS IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITALIS, ITS FOUNDERS, EMPLOYEES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APPS; (B) ANY HEALTH-RELATED DECISION MADE BASED ON INFORMATION FROM THE APPS; OR (C) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in such cases, the above limitations apply only to the extent permitted by law.
You agree to indemnify and hold harmless Vitalis and its team from any claims, damages, or expenses arising out of your misuse of the apps, your violation of these Terms, or your violation of any rights of another party.
You may stop using Vitalis at any time by uninstalling the apps. We reserve the right to suspend or terminate your access to the apps if you violate these Terms or engage in conduct that harms other users or the integrity of the service.
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date and, where reasonable, communicated in-app. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which Vitalis is incorporated, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction unless an alternative forum is required by mandatory consumer-protection law in your jurisdiction.
